TERMS AND CONDITIONS
By booking with Kingsize, you are working within a professional production environment.
These terms ensure shoots run smoothly and fairly for everyone.
1. Definitions
Kingsize = Kingsize Studios Limited
Customer = the person or entity hiring equipment, studio, personnel, or services
Hire = any use, including testing, borrowing, discounted or free use
Equipment = all items hired, including accessories, tools, cases, vehicles
Studio = any studio or working space at Kingsize
Personnel = any staff or contractors engaged by Kingsize
Goods = any items sold
Services = any services provided
Lost = lost, stolen, or missing
Damaged = damaged or destroyed, including cosmetic damage
Credit Account = account approved under clause 13
PPSA = Personal Property Securities Act 1999
2. General Terms
All business is conducted under these terms.
These terms override any others unless agreed in writing.
By booking or hiring, you accept these terms.
Terms cannot be altered without written agreement.
Failure to enforce a clause does not waive future enforcement.
All prices exclude GST unless stated.
3. Pricing and Payment
If no price is stated, current Kingsize rates apply.
Prices may change due to cost or exchange rate increases.
Payment terms:
• Non-credit clients: payment on confirmation or collection
• Credit clients: payment due by the 20th of the following month
Deposits may be required:
• non-refundable deposit to confirm booking
• refundable security deposit
Large bookings (over $5,000) may require:
• 50% deposit
• or full coverage of external costs
International clients may require full prepayment.
Credit accounts are only available to approved companies.
Quotes are valid for 30 days but may change.
4. Booking and Cancellations
A booking is confirmed once verbal or written approval is received.
Bookings must include setup and pack-down within booked time.
Overtime rates apply if exceeded.
Cancellation policy:
• cancellation fees may apply
• within 72 hours: up to 50% charge
Kingsize may charge cancellation at its discretion.
5. Use of Equipment and Studio
You may not re-hire or transfer use without permission.
Equipment must be used by competent persons.
No unauthorised repairs or interference.
All legal and safety regulations must be followed.
You must advise location and usage of equipment.
No hazardous use without prior approval.
6. Equipment Responsibility
You accept equipment in good working condition.
You must:
• check all gear before use
• ensure suitability for your shoot
Kingsize is not responsible for:
• incomplete kits not checked
• equipment performance
• data loss or recording failure
You are responsible from:
• time of collection
• until return is accepted by Kingsize
7. Returns and Condition
Return all items:
• complete
• clean
• properly packed
Late or missing items incur charges.
Acceptance on return does not confirm condition.
Post-hire checks determine final condition.
8. Insurance and Liability
Kingsize may insure equipment but is not obligated to.
You are responsible for:
• equipment
• personal property
• liability
Insurance excess:
• standard: $1,500 + GST
• high-risk (water, overseas, etc): $5,000 + GST
Payable within 7 days of a claim.
If using your own insurance:
• must be approved
• must include Kingsize as interested party
9. Loss and Damage
You are responsible for equipment from the time of collection until it is returned and accepted by Kingsize.
If equipment is lost or damaged
• damaged equipment must be returned to Kingsize immediately
• all loss or damage must be reported as soon as possible
The Customer is responsible for all associated costs, including:
• inspection and assessment
• repair costs
• full replacement cost (if required)
• freight and logistics
• third-party advice or reporting
• preparation of claims and documentation
Replacement and repair
Kingsize will determine, at its sole discretion:
• whether equipment is repaired or replaced
• who carries out the repair
• whether a monetary settlement is accepted
Lost equipment will be deemed unrecoverable after 14 days.
Ongoing hire charges
Hire charges continue until the equipment is repaired or replaced.
This is capped at:
• up to 13 weeks from the date of loss or damage
• or up to 4 weeks if Kingsize elects not to replace the equipment
10. Operational Charges
Additional charges may apply for:
• dirty returns
• improper packing
• inspection or disassembly
Replacement gear is charged at full rates.
11. Limitations of Liability
Kingsize is not liable for:
• consequential loss
• failure of equipment
• delays
You accept all goods and services at your own risk.
12. Ownership and Security
Goods remain property of Kingsize until fully paid.
Kingsize holds a PPSA security interest.
Kingsize may repossess goods if terms are breached.
13. Default and Recovery
If you default:
• Kingsize may terminate hire immediately
• repossess equipment without notice
• recover all costs
Interest may be charged on overdue payments.
You are liable for legal and recovery costs.
14. General Rights
Kingsize may:
• refuse bookings or credit
• request background or credit checks
• apply payments at its discretion
You may not:
• assign or transfer agreements
• pledge or encumber equipment
15. Studio Rules
During studio use:
• maintain public liability insurance
• avoid nuisance or disturbance
• no smoking
• keep noise reasonable
• protect all equipment and property
• follow health and safety laws
You must:
• remove all materials and rubbish
• return studio to original condition
• avoid intoxication or unsafe behaviour
• ensure minors have proper consent
16. Breakages, Losses, and Damage
You are responsible for all damage or loss during use.
Kingsize is not liable for:
• damage to your materials
• loss of profit or production failure
No alterations to studio without approval.
All breach-related costs must be paid.
Any issues must be reported immediately.
